Partner Jeremiah Lowe, Trial Attorney Victoria Lazar and co-counsel Norman Pokorny received a $1.7 million dollar verdict on behalf of their client 80-year-old Jim Gleboff in a personal injury auto accident case against the City of San Diego.
Jim was exiting an illegally parked vehicle that was struck from behind by a City vehicle. The City admitted negligence but disputed comparative fault, causation, and damages. This case was about whether the City of San Diego should be held fully responsible for its employee’s distracted driving and the value of physical health at an older age.
During trial, the City showed sub rosa video of Jim hiking and engaging in other activities. The City also argued that he had problems before the accident. After a two-week trial, a San Diego jury
returned a verdict in for Jim of $1,698,750.
“We don’t believe that older folks’ lives are worth any less or that they deserve any less when they get hurt,” said Founder John Gomez. “We are glad that the jury agreed and that justice has been served for Mr. Gleboff.”
